Any agreement deviating from the following conditions must be in writing to be valid.
1. Scope
The following General Terms and Conditions of Purchase, in their version valid at the time of the order, apply to the business relationship between Werbepräsente Hauptfleisch GmbH and Dometic Gesellschaft für Personaldienstleistungen mbH. In the absence of specific agreements, the general statutory provisions apply. Any conflicting terms and conditions of the purchaser are excluded.
2. Prices
All prices are subject to statutory VAT.
3. Conclusion of the contract
The "catalog"/"online shop" of Werbepräsente Hauptfleisch GmbH does not yet constitute a binding offer. A customer's order leads to a contract with Werbepräsente Hauptfleisch GmbH upon confirmation of the order. This occurs through the transmission of an order confirmation or by delivery of the goods. Upon acceptance of the order by Werbepräsente Hauptfleisch GmbH, a purchase agreement is concluded between the customer and Werbepräsente Hauptfleisch GmbH, under which Werbepräsente Hauptfleisch GmbH is obligated to transfer ownership of the goods to the customer upon payment of the purchase price.
4. Shipping and Payment Terms
Delivery is subject to a flat shipping fee of EUR 9.50 per package. This excludes all express and time-sensitive deliveries and international shipments, which are billed according to the respective service provider's price list. Shipping is at the recipient's expense and risk. We accept no liability for transport delays or defects caused by damage to the packaging; this also applies to deliveries agreed to be free of charge.
Die Berechnung erfolgt jeweils gesammelt zum Ende des Monats. Die Bezahlung unserer Ware hat innerhalb 7 Tagen nach Rechnungsdatum netto zu erfolgen.
5. Delivery time
Each order is processed immediately upon receipt. Delivery times are estimates only. If an item is no longer available, the customer will be notified.
6. Retention of title
The goods remain the property of Werbepräsente Hauptfleisch GmbH until full payment is received. Complaints will only be considered if they are made immediately upon or without delay after receipt of the goods. The warranty is limited to replacement delivery. Claims for damages are excluded.
7. Storage of data and contract content
The personal data and information of the customer required for processing the business transaction, as well as the order confirmation, which reiterates the object of purchase and the purchase price and thus the essential content of the contract, are stored by Werbepräsente Hauptfleisch GmbH for its own use only and are not passed on to third parties.
8. Place of jurisdiction
The place of jurisdiction is the company's registered office.
9. Final Provisions
German law applies.
Should any provision of these Terms and Conditions be or become invalid, the contract or the other valid provisions of these Terms and Conditions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the economic intent and purpose of the invalid provision. The same applies to any gaps in these Terms and Conditions.
